Vrtex Terms of Service Effective September 21, 2026

These Terms of Service ("Terms") govern your use of vrtex.shop (the "Site") and any purchase you make from Vrtex ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may only use the Site with the involvement of a parent or guardian.

2. Products We sell metal fidget spinners. Our spinners are made of solid metal with rounded, blunted edges. They are heavy. They are meant to be spun in the hand, not thrown, and not used as a tool or weapon. Please use them responsibly.

Our spinners contain small parts and are not intended for children under 3 years old. Adult supervision is recommended for young children. Keep spinners away from pets.

Product images are as accurate as we can make them, but metal finishes, colors, and small details can vary slightly from what you see on your screen.

3. Pricing and bundle deals Prices are listed in US dollars and may change at any time without notice. Bundle pricing (such as 2 for $22.99 or 3 for $29.99) is applied automatically at checkout based on the total number of spinners in your order, and cannot be combined with other discounts unless we say otherwise. If a pricing error appears on the Site, we may cancel any order placed at the incorrect price and will refund you in full.

4. Orders When you place an order, you are making an offer to buy. We may accept or decline it. We reserve the right to limit quantities, refuse or cancel any order, including orders that appear to be placed by resellers, orders with billing or shipping information we cannot verify, and orders flagged by fraud screening. If we cancel an order after you have paid, we will refund you in full.

You agree to provide accurate, current, and complete purchase and account information, and to update it as needed so we can complete your order and contact you if necessary.

5. Shipping, returns, and refunds Shipping is governed by our Shipping Policy, and returns and refunds by our Refund Policy, both of which are part of these Terms. Risk of loss passes to you when we hand the package to the carrier, but we will still help you resolve lost or damaged deliveries as described in our Shipping Policy.

6. Intellectual property The Vrtex name, logo, emblem, site design, product names, photography, and text are our property or used with permission and are protected by trademark and copyright law. You may not copy, reproduce, or use them for any commercial purpose without our written consent.

Vrtex is an independent brand. Our product designs are inspired by classic throwing star and blade shapes. Vrtex is not affiliated with, endorsed by, or sponsored by any anime, manga, game, film, or entertainment franchise, studio, or publisher. Any names of such franchises that may appear in customer content or reviews belong to their respective owners.

7. Acceptable use You agree not to use the Site for any unlawful purpose, to attempt to interfere with the Site's security or operation, to scrape or copy Site content, to submit false or misleading information, or to place fraudulent orders.

8. Third party services The Site is hosted on Shopify and uses third party payment processors and shipping carriers. Their services are governed by their own terms and policies, and we are not responsible for their content or practices.

9. Disclaimer of warranties Except as expressly stated in these Terms or required by law, the Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted or error free.

10. Limitation of liability To the fullest extent permitted by law, Vrtex and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or damage arising from misuse of a product, including throwing a spinner, using it as a tool or weapon, or giving it to a child without supervision. Our total liability for any claim relating to a purchase is limited to the amount you paid for that order.

Some states do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification You agree to indemnify and hold harmless Vrtex and its owner from any claims, damages, or expenses, including reasonable attorney fees, arising from your breach of these Terms or your misuse of a product.

12. Governing law and disputes These Terms are governed by the laws of the State of California and the United States, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at vrtexshopig@gmail.com and give us 30 days to try to resolve it.

13. Changes We may update these Terms at any time by posting the new version on the Site. Your continued use of the Site after a change means you accept the updated Terms.
